Abstract India spends Rs. 3,50,000 crores annually in the engineering field, second only to agriculture. However, it suffers from same malaise as agriculture. Our experience has shown that mismanagement of engineering projects cost at least 15% per year i.e. over Rs. 52000 crores of wastage. The mismanagement is attributable to failure of project administration rather then want of technical skill and other relevant resources. The deficient administrative skill substantially means a badly administered interpreted and failure of contract.
It is in this context the study of business law which essentially would mean Law of Contract, the methods of disputes resolutions and the peripheral laws concerning labour, Industrial disputes, Company etc affairs are important. Intellectual Property Rights, cyber laws give new dimension to traditional Business Law.
We are the only people to claim to have codified law of contract as the same is understood in modern times. We have long history of laws contract having been discussed by Chanakya, Bruhaspati, Katyayan, and Narad etc. Construction Law also was recognized in Babylonia 2000 years before Christ. Romans codified this law almost 1000 years before Christ.
Our understanding, appreciations and reforms in law will depend upon number of technocrats who could develop flair for study of law and make their contribution. Conventional lawyers, Judges and advocates can not accelerate the process of interaction for betterment of engineering law, without academicians and professional getting involved.
In this context, we have some of the excellent judgments delivered by our courts admittedly that quite many of other judgments need be reviewed.
